Other than this limited license of personal use, no other right, title, or interest in any intellectual property owned or licensed by Company, including but not limited to, any Patent, Trademarks, and Copyright is being granted to You.

Your license to use the QuickMod Pro Software and any third-party data will terminate if You violate these restrictions. Company may provide You with customer support assistance which will enable You to apply for Loan modification. • Sell, lease, loan, distribute, transfer, or sublicense the QuickMod Pro Software or derive income from the use or provision of the QuickMod Pro Software without Company’s prior, express, written permission.

IF THE QUICKMODPRO SOFTWARE DOWNLOADED BY YOU IS RENDERED USELESS OR IF YOUR LOAN MODIFICATION APPLICATION IS REFUSED DUE TO YOUR PERSONAL CONDITIONS, GOVERNMENT ACTION OR CHANGES IN POLICY ADOPTED BY BANKS AND LENDERS, YOU AGREE AND UNDERSTAND THAT COMPANY SHALL NOT BE LIABLE TO YOU. COMPANY MERELY PROVIDES YOU WITH TOOLS NECESSARY TO MAKE AN APPLICATION FOR LOAN MODIFICATION AND DOES NOT PROVIDE ANY LEGAL, FINANCIAL OR PROFESSIONAL ADVICE SPECIFIC TO YOUR CONDITIONS.

o YOUR INABILITY TO USE THE QUICKMODPRO SOFTWARE, OR INFORMATION, DATA AND DOCUMENTS AVAILABLE THROUGH QUICKMODPRO SOFTWARE DUE TO YOUR PERSONAL CONDITIONS, GOVERNMENT ACTION OR CHANGES IN POLICY ADOPTED BY BANKS AND LENDERS;
o ANY CHANGES WHICH COMPANY MAY MAKE TO THE QUICKMODPRO SOFTWARE, OR INFORMATION, DATA AND DOCUMENTS AVAILABLE THROUGH QUICKMODPRO SOFTWARE;
o THE DELETION OF, CORRUPTION OF, OR AVAILABILITY OF QUICKMODPRO SOFTWARE, OR INFORMATION, DATA AND DOCUMENTS AVAILABLE THROUGH QUICKMODPRO SOFTWARE;
o YOUR FAILURE TO PROVIDE COMPANY WITH ACCURATE ACCOUNT INFORMATION;

THE LIMITATION ON COMPANY’S LIABILITY TO YOU IN THE PARAGRAPH ABOVE SHALL APPLY WHETHER OR NOT COMPANY HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

COMPANY’S TOTAL LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS OF SERVICES (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE SHALL NOT EXCEED IN AGGREGATE THE AMOUNT PAID BY YOU FOR THE QUICKMODPRO SOFTWARE.

AS SOME JURISDICTIONS DO NOT ALLOW SOME OF THE EXCLUSIONS OR LIMITATIONS AS ESTABLISHED ABOVE, SOME OF THESE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN THAT EVENT THE LIABILITY WILL BE LIMITED AS FAR AS LEGALLY POSSIBLE UNDER THE APPLICABLE LEGISLATION.

COMPANY SHALL NOT HAVE ANY LIABILITY TO YOU WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER FORM OF LIABILITY FOR FAILING TO PERFORM ITS OBLIGATIONS UNDER THESE TERMS OF SERVICE TO THE EXTENT THAT SUCH FAILURE IS AS A RESULT OF A FORCE MAJEURE EVENT.

MODIFICATIONS TO QUICKMODPRO SOFTWARE

Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the QuickMod Pro Software (or any part thereof) with or without notice. You agree that Company shall not be liable to You or to any third party for any modification, suspension or discontinuance of the QuickMod Pro Software. Company may also impose limits on certain features and services or restrict Your access to parts or all of the QuickMod Pro Software or the QuickMod Pro website without notice or liability.

TERMINATION

Your license to the QuickMod Pro Software and to access the contents therein Service or the QuickMod Pro Website continues until it is terminated by the Company, due to any reason, including termination due to changes in government’s policy. In the event of a termination, upon notification from the Company You must discontinue using all or any of the QuickMod Pro Software and destroy all the copies of the QuickMod Pro Software from Your personal computer or any other storage device.
